FlexPools is a design and manufacturing company specializing in high-end above-ground and modular pool solutions (“Products”), including fabrication, delivery coordination, and optional installation services.
All services are provided subject to availability and project-specific conditions.
2. Request a Quote (No Online Checkout)
Submitting a Request a Quote through our website does not constitute a purchase, contract, or binding agreement.

All quotes are non-binding estimates based on the information provided by the client.

Final pricing, scope, specifications, and timelines are confirmed only through a written proposal or agreementissued by FlexPools.

Quotes may change due to site conditions, customization requests, material availability, labor costs, or regulatory requirements.
FlexPools reserves the right to decline any project at its sole discretion.
3. Product Scope – Above-Ground Pools
FlexPools products are above-ground or surface-mounted pool systems, including modular and custom-fabricated designs.
Clients acknowledge that:

Above-ground pools differ structurally and visually from in-ground pools.

Site preparation requirements vary by location.

Final appearance and performance depend on proper installation, surface conditions, and maintenance.
4. Fabrication & Custom Manufacturing
Many FlexPools products are custom-fabricated.

Fabrication begins only after written approval and receipt of the required deposit.

Custom products cannot be canceled, modified, or refunded once fabrication has started.

Minor variations in materials, finishes, colors, or components may occur due to manufacturing processes or supplier availability.
5. Lead Times & Scheduling
All lead times provided are estimated, not guaranteed.
Delays may occur due to:

Custom fabrication

Supply chain disruptions

Weather conditions
-
Permit approvals
-
Site readiness
-
Third-party contractors or carriers
FlexPools is not liable for delays beyond its reasonable control.
6. Deposits & Payments

A non-refundable deposit is required to initiate fabrication and/or reserve installation scheduling.

Remaining balances are due according to the terms outlined in the written proposal or agreement.

Failure to make payments on time may result in project delays, suspension, or cancellation.
Deposits are applied toward the total project cost and are non-refundable, except as explicitly stated in writing.
7. Installation Services
Installation services, when offered, may be performed by:

Third-party contractors
Clients are responsible for:

Providing safe and unobstructed site access

Ensuring the site meets structural and surface requirements

Confirming utility locations and clearances
FlexPools is not responsible for:

Pre-existing site conditions

Structural issues unrelated to the pool system

Landscaping, decking, electrical, plumbing, fencing, or ancillary work unless explicitly included in writing
8. Permits & Municipal Approvals
Permits, zoning approvals, HOA approvals, and code compliance vary by jurisdiction.
Unless explicitly stated in writing:

The client is solely responsible for obtaining all required permits and approvals.

FlexPools does not guarantee permit approval or regulatory acceptance.
Delays or denials related to permits do not constitute grounds for cancellation or refund.
9. Warranties
FlexPools provides limited warranties on certain components as outlined in the applicable product documentation or agreement.
Warranty coverage:

Applies only to normal residential use

Does not cover misuse, abuse, improper installation, unauthorized modifications, or lack of maintenance

May exclude labor, transportation, or removal costs unless specified
Third-party components may carry separate manufacturer warranties.
10. Limitation of Liability
To the maximum extent permitted by law:

FlexPools shall not be liable for indirect, incidental, consequential, or special damages.

Total liability shall not exceed the amount paid by the client for the specific product or service giving rise to the claim.
11. Intellectual Property
All website content, designs, images, renderings, text, logos, and product concepts are the intellectual property of FlexPools and may not be copied, reproduced, or used without prior written consent.
12. Privacy
Use of this website is also governed by our Privacy Policy and Do Not Sell My Personal Information notice, which are incorporated into these Terms by reference.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict of law principles.
