Welcome to FlexPools. These Terms & Conditions (“Terms”) govern your access to and use of our website, services, products, and any requests submitted through our website. By accessing this website or submitting a request for a quote, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our website or services.
1. Company Information
FlexPools is a design and manufacturing company specializing in high-end above-ground and modular swimming pool products (“Products”). FlexPools manufactures and sells its Products and may assist with coordinating product transportation. FlexPools does not provide site evaluation, site preparation, unloading, crane services, placement, installation, electrical work, plumbing work, permitting, engineering or construction services.
All Products, manufacturing services and transportation arrangements are subject to availability and the terms of the applicable written proposal or purchase agreement.
2. Request a Quote (No Online Checkout)
Submitting a Request a Quote through our website does not constitute a purchase, contract, or binding agreement.

All quotes are non-binding estimates based on the information provided by the client.

Final pricing, scope, specifications, and timelines are confirmed only through a written proposal or agreementissued by FlexPools.

Quotes may change based on the selected model, size, customization options, material availability, destination, freight requirements, carrier charges, taxes and other project-specific product or transportation considerations.
Any information provided by FlexPools regarding dimensions, delivery or general product requirements is for informational purposes only and does not constitute an evaluation or approval of the customer’s property or proposed installation location.
3. Product Scope – Above-Ground Pools
FlexPools products are above-ground or surface-mounted pool systems, including modular and custom-fabricated designs.
Clients acknowledge that:

FlexPools Products are above-ground or surface-mounted pool systems and differ structurally and visually from traditional in-ground pools.

Every property and installation location has different access, foundation, utility, permitting and safety requirements.

The customer is solely responsible for determining whether the selected Product can be safely delivered to, placed and installed at the intended location.

Final appearance, performance and warranty eligibility depend on proper site preparation, placement, installation, connection, use and maintenance.
4. Fabrication & Custom Manufacturing
Many FlexPools products are custom-fabricated.

Fabrication begins only after written approval and receipt of the required deposit.

Custom products cannot be canceled, modified, or refunded once fabrication has started.

Minor variations in materials, finishes, colors, or components may occur due to manufacturing processes or supplier availability.
5. Lead Times & Scheduling
All lead times provided are estimated, not guaranteed.
Delays may occur due to:

Custom manufacturing requirements
-
Supply-chain disruptions or material availability
-
Weather conditions affecting manufacturing or transportation
-
Freight carrier availability or transportation delays

Changes requested by the customer
-
Failure to provide required information or payments
-
Customer inability to receive the Product on the scheduled date

Events outside FlexPools’ reasonable control
FlexPools is not liable for delays beyond its reasonable control.
6. Deposits & Payments

A non-refundable deposit is required to initiate manufacturing and/or reserve production scheduling.
-
Remaining balances are due according to the terms outlined in the written proposal or agreement.
-
Failure to make payments on time may result in project delays, suspension, or cancellation.
Deposits are applied toward the total project cost and are non-refundable, except as explicitly stated in writing.
7. Customer-Arranged Site Preparation and Installation
FlexPools does not provide or supervise site evaluation, site preparation, unloading, crane services, placement, installation, electrical work, plumbing work, fencing, decking, landscaping or other construction services.
The customer is solely responsible for hiring, coordinating and paying all qualified local professionals required to prepare the property, receive the Product and complete its placement and installation.
The customer is responsible for:

Confirming that the property and proposed location are suitable for the selected Product

Confirming delivery, truck and crane access

Preparing the required level foundation or support surface
-
Obtaining all required permits, inspections and HOA approvals

Locating utilities and maintaining required clearances
-
Hiring and coordinating the freight receiver, crane operator and installation contractors
-
Completing electrical, plumbing, fencing, drainage and other required work
-
Ensuring compliance with applicable building, zoning, electrical, plumbing and safety requirements
FlexPools is not responsible for the acts, omissions, workmanship, delays, charges or damages caused by any contractor, crane operator, carrier or other third party hired or coordinated by the customer.

roduct specifications, drawings and general guidance provided by FlexPools do not constitute engineering, architectural, construction, permitting or site-suitability advice.
8. Permits & Municipal Approvals
Permits, zoning requirements, HOA approvals, inspections and applicable building and safety codes vary by jurisdiction.
The customer is solely responsible for identifying and obtaining all permits, approvals and inspections required for delivery, placement, installation and use of the Product.
FlexPools does not apply for permits, interpret local codes, determine property suitability or guarantee permit approval or regulatory acceptance.
Permit delays, denials, required property modifications or other regulatory requirements do not constitute grounds for cancellation or refund once manufacturing has begun, except where otherwise required by law or expressly stated in writing.
9. Warranties
FlexPools provides limited warranties on certain components as outlined in the applicable product documentation, written warranty or purchase agreement.
Warranty coverage:

Applies only to the type of use specified in the applicable written warranty or purchase agreement.

Does not cover misuse, abuse, improper installation, unauthorized modifications, accidents, improper maintenance or failure to follow product instructions.

Does not cover damage caused during unloading, crane handling, placement, installation, electrical work, plumbing work or other services performed by the customer or third parties.

May exclude labor, transportation, removal, reinstallation or replacement-related costs unless expressly stated in writing.
Contractors, crane operators, carriers and other third parties hired or coordinated by the customer are independent from FlexPools. Their work is not performed, supervised or warranted by FlexPools.
Third-party components may be covered by separate warranties provided by their respective manufacturers.
Commercial, hospitality, multifamily, rental and public-use applications may be subject to different warranty terms, maintenance requirements and operating limitations. Any warranty applicable to such use must be expressly stated in the written proposal, purchase agreement or commercial warranty issued by FlexPools.
No statement on the website creates a commercial-use warranty or guarantees that a Product is suitable for a particular property, business operation or regulatory classification.
10. Limitation of Liability
To the maximum extent permitted by applicable law, FlexPools shall not be liable for business interruption, loss of use, loss of revenue, loss of profits, loss of bookings, loss of goodwill or other commercial losses arising from delays, site conditions, permitting, installation, third-party services, regulatory requirements, closure of an aquatic facility or the customer’s operation of the Product.
11. Intellectual Property
All website content, designs, images, renderings, text, logos, and product concepts are the intellectual property of FlexPools and may not be copied, reproduced, or used without prior written consent.
12. Privacy
Use of this website is also governed by our Privacy Policy and Do Not Sell My Personal Information notice, which are incorporated into these Terms by reference.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.
14. Changes to These Terms
FlexPools reserves the right to update or modify these Terms at any time. Changes will be effective upon posting on the website.

16. Commercial, Hospitality and Public Use
Any intended use of a FlexPools Product at a hotel, resort, vacation rental, multifamily property, homeowners’ association, commercial development or other location used by guests, tenants, customers or the public must be disclosed to FlexPools in writing before an order is accepted.
References to hospitality, commercial or development applications on the FlexPools website are illustrative only. They do not constitute confirmation that a Product is suitable, approved, certified or legally compliant for any particular commercial property, public use or jurisdiction.
The customer and property operator are solely responsible for determining whether the selected Product and proposed use comply with all applicable laws, codes, regulations and operating requirements, including, as applicable:

Public and commercial swimming pool regulations

Building, zoning, health and safety codes

Accessibility requirements, including applicable ADA requirements

Required permits, licenses and inspections

Barriers, fencing, gates, signage and safety equipment

Water treatment, testing and operational requirements

Supervision, staffing or lifeguard requirements
-
Occupancy and maximum-use limitations
-
Insurance requirements
-
Site preparation, unloading, crane placement and installation
The customer is responsible for consulting qualified local architects, engineers, contractors, accessibility professionals, health authorities and other appropriate professionals before purchasing, installing or operating a FlexPools Product for commercial, hospitality or public use.
FlexPools does not operate, manage, supervise or control the customer’s property or pool operations and is not responsible for the customer’s compliance with public-pool regulations, guest supervision, water quality management, safety procedures or day-to-day operation.
